Terms & Conditions for Peach Hayne Organics 

 

Peach Hayne Organics is a small family run enterprise producing Organic Products on our organic farm in the heart of Mid Devon. You may contact us using the contact form on the website or at peachhayneorganics.co.uk and peach-hayne-organics@hotmail.com 

 By using Peach Hayne Organics website and purchasing products you agree to our terms and conditions (see below). 

 

Delivery  

All prices include postcode limited delivery  (EX, PL, TQ and TA) on our standard delivery service. Simply: 

  • Place your order online 

  • Fill in the delivery details 

  • Limited delivery periods (EX, PL, TQ and TA) will be on allocated days, detailed on ‘How To Purchase’ screen. Please help to be flexible on these days during this busy season. 

  • We will contact you to confirm the delivery time on your chosen delivery date.

  • It is your responsibly to make suitable arrangement to receive your delivery. You do not have to be present to receive the tree on delivery day, but the risk is entirely yours if the tree is left in the open. You are able to leave instructions of a suitable location where your delivery can be left, if you are not at home to take receipt of your organic Christmas tree, which forms part of our contract under these terms and conditions.  

  • Once your delivery instructions have been followed and completed by us, you accept that you are in possession of the delivered goods. Where delivery instructions have been followed; we will not accept liability for damage to, or theft of, your goods, nor will we accept liability for any incidents which may arise as a result of the theft or damage to such goods.

 Coronavirus (COVID-19) Delivery Restrictions can be followed where requested.

  • Hands – Peach Hayne Organics team will be hand sanitising their hands at regular intervals. Especially, before your tree is handled and then again after your tree has been handled.

  • Space – Peach Hayne team will stay 2 metres apart from people where possible, or 1 metre with extra precautions in place (such as wearing face coverings or increasing ventilation indoors).

Order Terms & Conditions 

All prices displayed on the website are inclusive of any applicable taxes and duties (including VAT). Payment is made through a third party – either Paypal (Paypal or Venmo) or Stripe (Credit Card or Apple Pay). Please see their terms and conditions for more information. 

Please note that for all orders we are unable to cancel an order within 48 hours of the quoted delivery date as our trees are perishable and cut to order.  

We will make every effort to deliver your tree on the advertised date, however we are a small business and may need to alter the dates depending on demand. We will inform you of any changes as soon as possible.  

We will only refund a customer if their order has not been delivered after the close of business on the 23rd of December, only after this date will your order be considered late and refundable.  

Please inspect your goods thoroughly on arrival and also note that tree sizes can be 6" either way of your chosen height. Once you have taken delivery of your tree, we are unable to resend or replace. 

Any Pictures or descriptions made or referred to on our website or in further communication with yourself are representative only and we cannot guarantee your order will look precisely as described, as such no warranty as to appearance or dimensions can be provided nor is given. 

 

Changes to Delivery details 

Where possible we will seek to alter the delivery details of your order should it become apparent to you that there is a problem with the details you have provided. Where the requested change is a change of delivery address, this will need to be made in writing and from the original email account ordering the products.  

Where the requested change is a change of name, providing there is only minor changes required, this will be carried out free of charge. Such requests must be made in writing from the original email address that ordered the products.  

 

Cancellations 

Should you wish to cancel an order the following will apply: 

Where the cancellation is made on the same day (within 24 hours), providing you have not requested a special or rush next day delivery, no fee will be charged.  

Where a tree has been cut for a specifically requested next day delivery a fee of £85.00 is charged to cover a percentage of the loss of the tree (as these are perishable items which cannot be replaced or sold elsewhere), and other ancillary charges. 

Where a cancellation request is made after 24 hours but before 3 working days of your chosen delivery date a cancellation charge of £35.00 applies.  

If an order is cancelled within 3 working days of your chosen delivery date a cancellation charge of £85.00 (or where your order is less the full order cost) is charged to cover our  expenses incurred, including our charges incurred for wasted delivery slots. 

We are unable to cancel an order within 48 hours of the quoted delivery date as our trees are perishable and cut to order.  

 

Refused products 

Unless and until genuine good cause can be shown why a product has been refused, taking into consideration our delivery terms and conditions and the foregoing there shall be no refund as our products are perishable items which cannot be resold nor replaced. 

 

Measurements 

All measurements in respect of trees height and/or width are guides only and are not guarantees. The tree height may vary by up to 6" from the height stated and the widths are approximate indications only, based on past experience. As these are natural, organically grown UK product it is not possible to guarantee the height width nor weight of any of our goods. 

 

Insect life! 

As our trees are a natural, organically grown UK product they may upon delivery still host some insect life. Whilst every effort will be made to minimise this, these are considered natural and we can take no responsibility for their total removal. 

 

What to do if you are unhappy with your goods 

We make every effort to ensure that all our trees are of the highest quality and are fully inspected prior to dispatch.  If however, you feel that the tree received is not in reasonable condition then please contact us IMMEDIATELY.  Please bear in mind that our trees are an organically grown UK product and may vary in size and shape.   

It is important that you take an image of the tree as soon as possible so there is no doubt as to its condition when it was received. For trees delivered by us, we will also have taken an image to confirm delivery. 

We are unable to issue refunds for Organic Christmas Trees, unless damaged, as they are perishable items and are cut to order. However, we may in some circumstances, be able to replace a tree that has been shown to be damaged, this is totally at our discretion.

Governing Law 

These Terms and Conditions and any agreement made pursuant are subject to the application of English Law and any cause of action lies solely with the Courts of England and Wales only.
